Sale and Purchase Agreement in Islam

Sale in Arabic is (al-ba) means "exchanging something with something", and the contrary of sale is purchase or (Al-syira).  Ibn Qudamah expressed as follows: "Exchanging the property with the property with possession and delivery of a property".

Selling Principle

According to the Jumhur Ulama, there are four selling principle :

  1. The Seller (Ba'i) 
  2. The Buyer (Mustari)
  3. Ijab Qabul (Sighat)
  4. Object Of Purchase.


Terms of Sale and Purchase

First, the requirements relating to the practice of buying and selling, both sellers and buyers, namely:

Should both of buyer and seller with pleasure and voluntarily and without coercion.  

They are competent in the practice of buying and selling, that they were mukallaf and rasyid (have skills in managing money), so that unauthorized transactions made by a child, crazy person or the people who were forced.

Second, about the object / goods bought and sold, the terms are:

Object of the sale (either in the form of merchandise or price / cash) is holy and useful goods and not unclean or illicit goods, because the illicit goods is  forbidden to be traded.

Object of the sale is a full property rights, a person can sell goods that do not belong if it gets permission from the owner of the goods.

Object of the sale can be handed over, so it is not legally sell the birds that fly in the air, or person who sell camel escaped from the cage, etc. Transactions that contain objects such as buying and selling is forbidden because it contains gharar (speculation) and selling goods can not be delivered.

Object of the sale and the amount of payment must be clearly by both sides, for avoid gharar.

Third, Trade (Sale and Purchase) is not Riba

Condition of Islamic Bank in Indonesia 2016

Competition of financial service in Indonesia effected in performance of Islamic banking because Islamic Banking in Indonesia have several problem such as lack of capital, financial resources, human resources, and IT resources.

Islamic banking expected to contribute in supporting the economic transformation in productive economic activity, high value-added and inclusive, especially by exploiting demographic dividend and the prospect of high economic growth, so the role of Islamic banking may seem significant for the community.

Islamic banking has several problem that must be solved with strategic system.  Therefore, it is expected the Indonesian economy in 2016 will be recovered, especially with the number of infrastructure projects and improvements in the central and local government budget.

Chairman of the Indonesian Association of Islamic Economics (Agustianto Mingka) conclude,  in the construction of infrastructure projects are being intensively implemented by the government, should be able to take the role of Islamic banking. In this case the Islamic banks can perform a nice fellow syndicated financing Islamic banks as well as join (syndicated) with conventional banks.

Prediction in 2016,  the growth of Islamic banking assets estimated to be around 15%.  He revealed that in 2016 will be marked by the level of the financial services business competition intensifies, because of Asean Economic Community, which for the banking industry it is stated in the ASEAN Banking Integration Framework (ABIF). Increasing competition in the financial services industry will negatively affect the performance of Islamic banking because it is still constrained by several problems such as lack of capital, financial resources, human resources and IT are not yet qualified.

Actually a lot of profitable business opportunities for Islamic banking, such as international trade finance, sindicated financing, Margin During Construction (MDC), hybrid take over and refinancing, factoring, KPRS pivot, financing reimburs, IMBT and Ijarah Maushifah fizZimmah, and Musharaka Mutanaqishah. Akad Mutanaqishah Musharaka can be applied in 11 product and business needs of customers.
